Dear user (‘User’)! Cubu (‘We’ or ‘Company’ or ‘Cubu’) values your privacy and wishes to let you know how it handles your personal data.

This privacy policy explains which personal data is collected about you via our platform, a B2B online SaaS cloud-based platform, and our CubuTV service, (the ‘Platform’), as it is provided to our Business Customers (‘Business Customers’ or ‘Controllers’) for their independent use. This Policy also explains how we process your personal data.

Use of the Platform constitutes acceptance of this privacy policy, including Platform's other legal terms that can be viewed here, which will be updated from time to time.

Cubu operates as a Processor (or Service Provider) on behalf of its Business Customers, who control the processing of your personal data. We provide the Platform as a SaaS service (Software As A Service) and do not control, decide how to manage, or control the Platform. For example, we do not decide what kind of information may be collected through the Platform by each Controller.

 

What does the Platform do?

The Platform is a tool for our Business Customers to understand and manage your journey via their online websites, allowing them to manage and schedule appointments and communications. The Platform also measures and analyzes the journey from the point of submitting an inquiry or setting up an appointment via the Platform to the moment the inquiry or appointment is handled or executed.

Our CubuTV service is a visualization service/feature, allowing our customers to visualize the appointments queue within their premises, including the details of those in line.    

Children

The Services are not directed to individuals under 18. Cubu does not knowingly process or collect personal data of individuals under the age of 18. As the Platform provides full customization for its Business Customers, it is up to their decision. If you are a parent or a legal guardian of an individual under 18 and believe your child has provided personal data to Cubu, and therefore have further inquiries, please contact the relevant Business Customer.

What kind of information does the Platform collect?

While using the Platform, whether as a customer or as a service representative of the Controller, you may provide personal data, as follows:

  1. For making an appointment or submitting an inquiry – the platform may collect personal data for verification purposes, such as a mobile telephone number or e-mail address. Moreover, information regarding the appointment subject matter or further information might be asked, under the Controller’s discretion, hence – may change from website to website.

  2. While waiting for your queue and once scheduled, the Platform may collect the queue data, such as when will your queue be, when it was scheduled, estimated waiting time, the time elapsed, inquiry data, etc.

  3. While your inquiry is being handled by representatives of Controller, the Platform may collect data about the process, such as when handling of the inquiry by any representative begins and ends, when it is being transferred to another representative, etc.

  4. To display on-screen while waiting for an appointment, via our Cubu T.V service. The type and/or categories of personal data which would be collected on Cubu T.V will be determined at the Controller’s discretion. Any further information or specification regarding a Controller's website personal data collection should be elaborated within the Controller's Privacy Policy, accessible through the website itself.
     

Why does the Platform collect information?

The Platform mainly uses the information collected to provide our Services, for operational purposes and eventually, for the Controllers’ purposes. The information may also be used to improve Cubu Services, the Platform, and their efficiency, to create future services and products, based on our legitimate interests.

Either way, we do not share or sell any of the personal data with external third parties.

You are not obliged to provide any of the information above, but without it, the Platform may not be able to fully operate the Services or grant the User the use of the Platform.

Please note that we do not manage your consent to the use of the Services or the Platform. Thus, whenever you want to opt-out from any service provided by the Platform or to execute any of your data subject rights (as mentioned hereunder), you should contact the relevant Controller.

Sharing of information collected

We may share information, as follows:

With our Business Customers – The Controllers

As we operate as the Processors on behalf of our Business Customers, we will share with them the information collected, as described above.

For legal reasons

We may share User information if we reasonably believe that:

  1. It is necessary to comply with a legal process or inquiry (such as a court order, subpoena, or search warrant) or any other legal requirements of any governmental authority.

  2. It would potentially mitigate our liability in an actual or potential lawsuit.

  3. It is necessary to enforce this privacy policy or any other agreement in place between us, or between us and our Business Customer.

  4. It is necessary to investigate and prevent unauthorized transactions or other illegal activities, and/or;

  5. It is otherwise necessary or appropriate to protect our rights or property or the rights or property of any person or entity.
     

Affiliates and Partners

We may only share information that will not identify you personally, with our affiliates, subsidiaries, parent companies, partners, or other affiliates of Cubu in order to deliver and improve the Services and the Platform, or to produce future services and products.

Structural Changes

In any case of acquisition, merger, or any other structural change of Cubu, we may share the information collected, provided that the said entity shall undertake the provisions of this Privacy Policy.

Retention

We may retain your information as needed to pursue our purposes as described above, for the duration of our engagement with our Business Customers, for complying with legal and regulatory duties, to resolve future or ongoing disputes, to enforce our agreements, and for various tax purposes and requirements.

We may keep aggregated non-identifiable information without limitation, and to the extent reasonable we will delete or de-identify potentially identifiable information when we no longer need to process the information.

Data Subject Rights

You may be eligible for Data Subject Rights, such as access, rectification, review, deletion, etc., under applicable law. As we operate as Processors on behalf of our Business Customers, for any inquiry relating to your Data Subject Rights, you may approach them directly.

How do We keep information secure?

Cubu uses security measures designed to protect against the loss, misuse, and alteration of the information collected on the Platform. For certain services, data transfers are encrypted during transmission. Cubu is taking any reasonable action to keep the User’s information safe. Nevertheless, Cubu is not responsible for any damages to the information, or to the functionality of the Platform, caused by reasons beyond its control, misuse by the Business Customer, force majeure, cyber-attacks, pandemics, strikes, etc.

If you are sharing personal data with our Business Customers, by the use of our Services or otherwise, you should review the privacy practices of that Business Customer, to better understand which personal data it collects and processes about you, and which security measures it applies.

Miscellaneous

The Platform may include links to other websites or platforms, which are not operated by Cubu. These links are not under the control of Cubu and by clicking them you will be subject to these websites or platforms’ privacy policies and terms of use.

We recommend that you review this privacy policy periodically, as we may update it from time to time. Your actions via our Services and the Platform, as applicable, constitute your acknowledgment of the up-to-date privacy notice to the fullest extent permitted by law.
